1. Acceptance of Terms
By downloading, installing, or using AI Image Editor ("the App"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, do not use the App.
2. Use of the App
The App is intended for personal, non-commercial use. You may not use the App in any way that violates applicable laws, regulations, or the rights of others. You also agree not to attempt unauthorized access, reverse engineering, tampering, or disrupting the functionality or integrity of the App or its services.
3. Token-Based Transactions
The App operates on a credit-based system using tokens. You may purchase tokens through in-app purchases. Each image edit consumes a specific number of tokens depending on the complexity and type of operation.
- All token purchases are final and non-refundable, except where required by law.
- Unused tokens do not expire but cannot be transferred or exchanged for cash.
- If a request is denied or rejected (e.g., due to prohibited content or AI limitations), tokens consumed during the attempt will not be refunded.
- We reserve the right to change token pricing or consumption rates at any time without prior notice.
4. Prohibited Content
You agree not to use the App to upload, process, or generate content that is illegal, abusive, explicit, violent, hateful, pornographic, harassing, discriminatory, infringing, or otherwise inappropriate under applicable law or these Terms.
You are solely responsible for any content submitted through the App. If your content violates these rules or is rejected by our processing system (including AI filters), no refunds will be issued for consumed tokens.
5. Intellectual Property
All intellectual property rights in and to the App, including software, interface design, logos, and branding, are and will remain the exclusive property of the App’s creators and licensors. You may not reproduce, distribute, or create derivative works based on any part of the App without express written permission.
6. AI Limitations
The App leverages third-party AI systems (such as OpenAI) for image editing. These systems may sometimes reject, misinterpret, or incompletely process images. We are not responsible for any inaccuracies, content quality issues, or denials due to AI limitations.
Edits that fail due to such limitations still consume tokens and will not be refunded.
7. Payment and Billing
All token purchases are handled through the Apple App Store and subject to Apple’s terms and conditions. We do not store or process payment information directly.
8. Refund Policy
As a digital service with immediate token access, we do not offer refunds for completed purchases. Refund requests must be handled through Apple Support in accordance with their refund policy.
9. Disclaimer
The App is provided “as is” and “as available” without any warranties, either express or implied. We do not guarantee uninterrupted availability or error-free operation of the App or its services. We are not liable for loss of data, images, tokens, or edits caused by connectivity issues, service outages, AI rejection, or user error.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, data loss, or business interruption — arising out of or related to your use or inability to use the App.
11. Termination
We reserve the right to suspend, restrict, or terminate access to the App, its services, or specific user accounts at any time, with or without notice, and for any reason, including violation of these Terms or suspected abuse.
In the event that the App is permanently discontinued or shut down, all unused tokens may become invalid and inaccessible. By using the App, you acknowledge and agree that no compensation, refund, or data transfer is guaranteed for unused tokens in such a scenario.
You are solely responsible for using your tokens while the service is active. We strongly recommend using purchased tokens in a timely manner.
12. Modifications to the App
We may update, modify, or discontinue any part of the App, including features, pricing, or token functionality, at our sole discretion and without prior notice.
While we strive to provide continuity of service, we are under no obligation to maintain the App or support its availability indefinitely. You agree that we shall not be liable for any modification, suspension, or discontinuation of the App or any part thereof.
13. Changes to These Terms
We may update or revise these Terms at any time. When we do, we will update the “Last Updated” date and post the revised version. Continued use of the App after any such changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Germany. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Germany.
